It is not merely a regulatory hurdle but a proactive management tool designed to balance industrial growth with environmental protection.

In India, the EIA process is legally mandated under the Environment (Protection) Act, 1986. The process was formally institutionalized through the EIA Notification of 1994, which was later superseded by the more comprehensive EIA Notification of 2006. This legal framework ensures that any project falling under the specified categories must obtain prior environmental clearance (EC) from either the Ministry of Environment, Forest and Climate Change (MoEFCC) or the State Environment Impact Assessment Authority (SEIAA).

The EIA Cycle: Procedural Stages

The EIA process follows a structured sequence to ensure transparency and scientific rigor. It begins with Screening, where projects are categorized into Category A (requiring clearance from the Central Government) and Category B (requiring clearance from the State level). This categorization is based on the scale, nature, and potential impact of the project.

Following screening, the process moves to Scoping. Here, the expert committee determines the “Terms of Reference” (ToR), which outline the specific environmental issues that the project proponent must study. Once the study is conducted, the proponent prepares an Environment Impact Statement (EIS), which serves as the core technical document for the assessment.

Furthermore, the lack of post-project monitoring means that the implementation of mitigation measures is often ignored once the clearance is granted.

Another challenge is the exclusion of certain projects from the public hearing process, which disenfranchises local communities. Additionally, the rapid pace of industrialization often results in “rushed” assessments that fail to capture long-term cumulative impacts on fragile ecosystems, such as the Himalayan region or coastal zones.
